Para demostrar que se ha infringido el art\u00edculo 20001, apartados (a) y (b)(1), del C\u00f3digo de Tr\u00e1fico, hay que demostrar cada uno de los siguientes elementos durante el juicio:   <\/p><ol><li>Una persona, mientras conduc\u00eda un veh\u00edculo a motor, se vio involucrada en un accidente que provoc\u00f3 lesiones a otra persona;<\/li><li>Esa persona sab\u00eda que se hab\u00eda producido un accidente;<\/li><li>Esa persona sab\u00eda que [\u00e9l] [ella] hab\u00eda estado involucrada en el accidente y, adem\u00e1s, sab\u00eda:<ul><li>que la otra persona hab\u00eda resultado herida; o<\/li><li>que, dada la naturaleza del accidente, era probable que hubiera otra persona herida;<\/li><\/ul><\/li><li>Esa persona incumpli\u00f3 deliberadamente una o varias de las siguientes obligaciones:<ul><li>Detenerte inmediatamente en el lugar del accidente; y<\/li><li>Para facilitar la siguiente informaci\u00f3n:<ul><li>su nombre;<\/li><li>direcci\u00f3n de residencia actual;<\/li><li>el n\u00famero de matr\u00edcula del veh\u00edculo;<\/li><li>el nombre y el domicilio actual del propietario del veh\u00edculo, as\u00ed como el nombre y el domicilio actual de cualquier ocupante del veh\u00edculo del conductor que haya resultado herido en el accidente, tanto a la persona herida como al conductor o a los ocupantes del otro veh\u00edculo, si los hubiera, y a cualquier agente de tr\u00e1fico o de polic\u00eda presente en el lugar del accidente; y<\/li><li>si se le pidi\u00f3, no mostr\u00f3 su carn\u00e9 de conducir; y<\/li><\/ul><\/li><\/ul><\/li><li>Prestar la asistencia necesaria a una persona herida; y<\/li><li>Si no hab\u00eda ning\u00fan agente en el lugar del accidente a quien facilitar la informaci\u00f3n, debes comunicar el accidente sin demora a la oficina m\u00e1s cercana de la Patrulla de Carreteras de California o a una autoridad policial debidamente autorizada, y presentar el informe con los datos necesarios.<\/li><\/ol><p>Para demostrar que se ha infringido el art\u00edculo 20001, apartados (a) y (b)(2), del C\u00f3digo de Circulaci\u00f3n, hay que demostrar el siguiente elemento adicional:  <\/p><p>El accidente provoc\u00f3 la muerte o lesiones graves y permanentes a la v\u00edctima.<\/p><h3>Definiciones seg\u00fan la ley de California sobre el delito grave de atropello y fuga<\/h3><p>La palabra \u00aba sabiendas\u00bb significa que el conductor del veh\u00edculo implicado sab\u00eda que se hab\u00eda producido un accidente, sab\u00eda que estaba implicado en \u00e9l y, adem\u00e1s, o bien sab\u00eda que el accidente hab\u00eda provocado lesiones o la muerte de una persona, o bien sab\u00eda que era de tal naturaleza que era probable que provocara lesiones o la muerte.<\/p><p>La palabra \u00abimplicado\u00bb, tal y como se utiliza en la ley sobre el delito grave de atropello y fuga, significa estar relacionado con un accidente de forma natural o l\u00f3gica. Las penas son m\u00e1s severas en los casos de lesiones corporales graves que en los de lesiones corporales leves. Las sanciones por una condena en virtud del art\u00edculo 20001(b)(2) del C\u00f3digo de Circulaci\u00f3n de California (CVC) como delito menor incluyen:  <\/p><ul><li>prisi\u00f3n de hasta un a\u00f1o, con una pena m\u00ednima obligatoria de 90 d\u00edas de c\u00e1rcel; y\/o<\/li><\/ul><ul><li>una multa de entre 1.000 y 10.000 d\u00f3lares.<\/li><\/ul><p>Si el tribunal expone los motivos en el expediente, puede reducir o eliminar el requisito m\u00ednimo obligatorio de 90 d\u00edas cuando ello redunde en el \u00abinter\u00e9s de la justicia\u00bb.
